Terms of Service

By creating an account or using IndCars99 (the website at https://indcars99.com and our mobile apps, together the “Service”) you agree to these Terms, our Privacy Policy, Refund & Cancellation Policy and Data Deletion Policy. If you do not agree, do not use the Service. The Service is provided by GODSVISION MULTI BUSINESS DEVELOPMENT PVT LTD, No 314/5, 16th Main, Opp St.Francis School, Begur Road, Begur, Bangalore, Bengaluru (Bangalore) Urban, Karnataka, 560068.

You must be at least 18 years old and able to enter a binding contract under Indian law.

IndCars99 is an online marketplace and intermediary. We provide the technology that lets buyers meet sellers and renters meet hosts, plus tools such as listings, 360° walkarounds, chat and offers.

Any inspection badge, verification tick, guarantee or protection programme shown in the app is governed by the specific terms shown with it and is limited to what those terms say.

• Sign up with a mobile number (verified by OTP), email and password, or with Google. Give accurate information and keep it up to date.
• You are responsible for everything done through your account. Keep your password and OTPs secret and tell us at once about unauthorised use.
• One person, one account. Do not sell, share or transfer your account.
• We may verify your identity or listings and may refuse or remove an account that fails verification.

Browsing is free. Some features — such as seeing seller contact details or publishing a vehicle for sale — need a paid plan.

• Prices are in Indian rupees and shown at checkout, inclusive or exclusive of applicable taxes as displayed. We may change prices or plans; a change never affects a pass you have already paid for.
• Passes are currently one-time purchases with no automatic renewal. Buying the plan you already hold extends it from its current expiry. If we ever offer auto-renewing plans, we will show the renewal price and date and obtain your explicit UPI AutoPay/card mandate first, and you will be able to cancel from your account at any time.
• Access ends on the expiry date; features that need a plan stop working then. Your existing account and data are not deleted.
• Payments are processed by Razorpay. Membership is activated only after the payment is confirmed. You get an invoice for each payment.
• Refunds are governed by our Refund & Cancellation Policy.
• Fees are for access to the Service, not a commission on any sale or rental, and do not guarantee that you will sell, buy or rent a vehicle.

• Listings are created by sellers. Prices, condition, kilometres, ownership and documents are the seller’s statements. Verify them before paying.
• Do not pay a token or balance before you have seen the vehicle and its original RC. Prefer traceable payment methods and written receipts.
• Offers and chats are not binding until you and the seller agree and complete the sale under Indian law.

• You may list only a vehicle you own or are authorised to sell, and only with an active plan that includes listing.
• Your listing must be accurate and complete: no concealed accidents, flood damage, odometer tampering, pending challans, loans or disputes. Use only your own photos of the actual vehicle.
• You are responsible for lawful transfer of ownership, including RC transfer, insurance and clearing any hypothecation.
• We may edit formatting, reorder, feature, remove or reject listings that break these Terms or the law.

• To rent you must hold a valid Indian driving licence for the vehicle type (and be of the minimum age the host requires). You must provide the licence number at booking and show the original at pickup.
• The rate, deposit, kilometre limit, extra-km charge, fuel rule and cancellation terms shown on the booking are the terms of your rental. Read them before you confirm.
• You are responsible for the vehicle while it is with you: traffic fines and challans, tolls, fuel, damage, loss or theft, as set out in the booking and by law. Do not sublet, race, drive under the influence or use the vehicle for unlawful purposes.
• Inspect the vehicle at pickup and note existing damage with photos. Return it on time and in the agreed condition.
• Booking status shown in the app (pending, confirmed, completed, cancelled) reflects the record between you and the host. Payment made in person or directly to the host is between you and the host.

• You may list a vehicle for rent only if you own it or are authorised to rent it out, and it has valid registration, insurance and permits suitable for the rental (a commercial permit may be required for self-drive rental in some places).
• You set your own rates, deposit and rules within the law. You are responsible for the vehicle’s roadworthiness, accurate availability, honouring confirmed bookings and returning deposits as agreed.
• You are responsible for your own taxes (including GST, where applicable) on your rental income.
• Check the renter’s driving licence and ID at handover. Take dated photos before and after each rental.

• Sponsored placements (banners, sponsored vehicles, announcements, spotlights) are sold under a written order or agreement that states the placement, schedule and price. If anything conflicts, that agreement prevails over these Terms for the advertising.
• Advertisers must have the right to all creative they submit and comply with applicable law and advertising standards (including ASCI guidelines). Ads must not be misleading, discriminatory, unlawful or infringe anyone’s rights.
• We review ads and may reject, pause or remove any ad at any time. Placement, ordering and reach depend on the schedule and on available inventory; we do not guarantee a number of views, clicks or sales unless the order says so.
• Advertisers are responsible for the accuracy of the landing pages and offers they link to.

You own the photos, videos, text and other content you upload (“Your Content”). You give IndCars99 a worldwide, non-exclusive, royalty-free licence to host, store, process (for example, resize and remove backgrounds), display and distribute Your Content on the Service and in our own promotion of the Service, for as long as it is on the Service. You confirm you have the rights to grant this licence and that Your Content is lawful and accurate. The IndCars99 name, logo, software and design belong to us or our licensors.

You agree not to:

• list stolen, hypothecated-without-disclosure, non-existent or misrepresented vehicles, or post false, misleading or fraudulent content;
• use the Service to defraud, harass, threaten or spam others;
• scrape, copy or resell listings or contact details, or use bots or automated means without written permission;
• upload malware, probe or interfere with our systems, or bypass security, rate limits or payment checks;
• impersonate anyone, create fake accounts or reviews, or share another person’s personal data without consent;
• post content that is unlawful, obscene, defamatory, hateful, or violates intellectual-property or privacy rights.

You can report a listing or user in the app. We review reports and may take a listing down, warn, restrict or ban an account. Under the IT (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, complaints can be sent to our Grievance Officer at indcars99@gmail.com; we acknowledge within 48 hours and aim to resolve within 15 days.

The Service is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including that the Service will be uninterrupted or error-free, and any warranty about a vehicle, a listing, a user, or their ownership, condition, price or documents. Information such as valuations, estimates and 360° imagery is indicative only.

To the extent permitted by law, IndCars99 is not liable for any indirect, incidental or consequential loss, loss of profit or opportunity, or for any loss arising from a transaction, rental, accident, fine, damage or dispute between users. Our total liability to you for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing in these Terms excludes liability that cannot be excluded by law.

You will indemnify and hold IndCars99 and its officers and employees harmless from claims, losses and expenses (including reasonable legal fees) arising from Your Content, your breach of these Terms or the law, or your dealings with other users.

You may stop using the Service and delete your account at any time (see the Data Deletion Policy). We may suspend or terminate your access, remove content or cancel a plan without refund if you breach these Terms, act unlawfully or create risk for others; where we end a plan without your fault we will refund the unused portion. Sections that by their nature should survive (ownership, disclaimers, liability, indemnity, governing law) continue after termination.

These Terms are governed by the laws of India. Please write to us first to resolve any dispute. Failing that, disputes will be subject to the exclusive jurisdiction of the courts at Bengaluru, Karnataka.

We may update these Terms as the Service or the law changes. We will change the date above and, for material changes, notify you in the app or by email. Continuing to use the Service after the effective date is acceptance. If you do not agree, stop using it and delete your account.
